A victim may participate in criminal proceedings, submit evidence and objections and, where the law permits, bring a civil claim. Certain offences are prosecuted not by the public prosecutor but on the basis of a private complaint filed directly with the court.
Private Complaint
This procedure applies only to offences expressly defined by law, which may include insult, defamation and certain cases of minor bodily injury or threats. The complaint must accurately describe the act, time, place, alleged offender and evidence, and must be filed within the special statutory time limit.
Victims in Public Prosecutions
A victim has the right to receive information, submit evidence and appeal certain decisions. At the court stage, the victim may apply to participate as a private prosecutor and civil claimant where the legal conditions are met.
Compensation
Pecuniary and non-pecuniary damage may be claimed in the criminal proceedings or in a separate civil action. The appropriate route depends on the progress of the criminal case, the available evidence and the victim's interests.
Consultation
Please provide the case documents, medical records, messages and an exact chronology of events.
