Compulsory Road Traffic Measures and Driving Licence Seizure

Compulsory administrative measures under Bulgarian road traffic law are temporary preventive measures rather than penalties. They may include temporary seizure of a driving licence, termination of a vehicle's registration, removal of number plates or suspension of a vehicle from use.

Scope of the Review

We examine the legal basis for the measure, the authority's jurisdiction, the reasons stated in the order, service and the supporting evidence, including inspection records, medical testing forms, laboratory results and documents concerning ownership or use of the vehicle.

Appeal and Enforcement

An appeal does not normally suspend enforcement. A reasoned application for suspension may therefore be required where enforcement may cause significant or irreparable harm. Related criminal or administrative-penalty proceedings do not replace the separate appeal against the compulsory measure.

Why Each Act Must Be Addressed Separately

The offence report, penalty decree and compulsory-measure order have different purposes and may have different appeal periods. Annulment of one does not automatically invalidate the others.
