A marriage in Bulgaria may be dissolved by mutual consent or through contested proceedings. The appropriate route affects the evidence required, the other spouse's participation and the issues the court must decide.
Divorce by Mutual Consent
When both spouses have a serious and unwavering intention to divorce, the court does not examine the reasons for the separation. The spouses must submit a complete agreement covering parental responsibility, the child's residence and maintenance, contact with the other parent, use of the family home, the family name and any maintenance between the spouses. The agreement must be workable and protect the interests of the children. Both spouses are normally required to appear in person.
Contested Divorce
If no agreement can be reached, either spouse may seek a divorce on the ground that the marriage has deeply and irretrievably broken down. The case may also determine matters concerning the children, the family home, the family name and maintenance. The court rules on fault only if requested. The evidence and litigation strategy depend on the disputed facts.
Property Matters
Divorce does not automatically resolve every dispute over marital property. Real estate, bank accounts, vehicles or company interests may require a separate agreement or court proceedings.
Consultation
To advise on the appropriate procedure, we will need information about the marriage, the children, the family home and whether the spouses have reached any agreement.
