Employees are entitled to the agreed remuneration and statutory compensation. Non-payment may be proven not only by payroll records but also by the employment contract, electronic employment record, bank statements, work schedules, correspondence and other evidence of work performed.
Amounts That May Be Claimed
- unpaid basic salary and additional remuneration;
- pay for overtime, night work or work on public holidays;
- compensation for unused paid annual leave;
- compensation following termination, failure to give notice or unfair dismissal;
- statutory interest for late payment.
Proving the Employment Relationship
Where the employer has failed to prepare the documentation correctly, we assess whether the actual work can be proven and whether the Labour Inspectorate should be notified. A court claim must identify the period and calculation of each amount.
Limitation Periods
Employment claims are subject to statutory limitation periods. Each monthly payment or item of compensation is assessed separately, so delay may reduce the recoverable amount.
Consultation
Useful documents include the contract, orders, payslips, bank statements and work schedules.
