Compensation for Pecuniary and Non-Pecuniary Damage

Where unlawful conduct causes harm, the injured party may claim compensation if the statutory conditions are met. Liability may arise from breach of contract, tort or special legislation.

Pecuniary Damage

This includes actual financial loss and loss of profit capable of monetary assessment. Evidence may include contracts, invoices, payment records, expert reports and income data. Future expenses are awarded only where sufficiently certain and linked to the harm.

Non-Pecuniary Damage

This covers pain, suffering, fear, humiliation and adverse effects on personal and family life. The court determines the amount on an equitable basis using specific evidence of the nature, duration and intensity of the experience.

Causation and Contributory Fault

Compensation covers the direct and immediate consequences of the responsible person's conduct. If the injured party contributed to the occurrence or extent of the harm, the award may be reduced. The limitation period depends on the legal basis and starting point.
